High court at Fort-portal city has dismissed with costs the civil suit no 1of 2022 filed by Hon. Aprunalis Kalibogha under Kithende hostels project, a non-governmental organization claiming ownership of over 200 acre land in Rwentutu village, lake Katwe subcounty in Kasese district.
The suit land was donated to the Diocese of Kasese by Ms Eleonora Wilsmer, a Swiss national after the claimant, Mr. Aprunalis Kithende Kalibogha and others civil suits were dismissed by the Court of Appeal and in 2010 and later in 2020 by the Supreme Court in favor of the respondent.
Speaking to Kasese Guide Radio last evening, Mr. Aaron Mukababirwa Muhindo, as respond and an attorney to the Ms Eleonora confirmed that High court at Fort-portal presided over by Justice Vincent Emmy Mugabo had dismissed the case on grounds among others; that Kithende Hostels Projects, a non- existing NGO sued in error by law.
Mr. Aaron also said the case had been taken by events now that the suit land case had been ruled over by superior courts against Hon. Aprunalis Kalibogha Kithende and his former Kithende Hostel Projects.
According to judgment over the miscellaneous application 091 0f 2022 arising from the civil suit No.01 of 2022 filed by Kithende Hostels Project led by Hon. Kithende, the application succeeds with costs yet to be computed to the applicant. Mr. Mukababirwa speaking1……….
Mr. Aaron had earlier called for calm among locals now that there was more to scare their occupancy on the Rwentutu piece of land. END
