The Kasese Chief Magistrate Court has dismissed an application seeking a vote recount in the Busongora County South Parliamentary race between Hon. Jackson Mbaju Kathika and the MP elect, Mr. David Isimbwa Mulindwa.
The Court presided over by His Worship, George Mfitundinda on Friday 23rd January 2026, received an application from National Unity Platform’s candidate, Hon. Kathika that the election results in particular polling stations were altered in favor of the NRM’s David Mulindwa.
In the application, Mr. Mulindwa is accused of having three declaration forms with different figures compared to those owned by the rest of the other six candidates who contested for the seat.
The three contested polling stations include, St. Peters primary school Compound in Kyarukara Ward, St. Jude primary school A-K in Rwenjubu ward and Jabez primary school compound A-K, all in Katwe Kabatooro Town Council in Kasese district.
At 11:36am today, His Worship Mfitundinda started the process by inviting the Electoral Commission officials to deliver the boxes before calling the candidates together with their lawyers to witness.
In his ruling minutes later, His Worship Mfitundinda dismissed the application on grounds that the ballot boxes had been tempered with, saying it would be futile to rely on compromised evidence to deliver justice to the applicant, Hon. Kathika, whom he advised to explore other remedies and in this case, filing an election petition in the High Court.
Speaking to the press after the Court session, Hon. Kathika explained that he was more than ready to file in the High court a petition challenging the victory of Mr. Mulindwa as the duly elected Member of Parliament for the constituency. Hon. Kathika speaking………
Mr. Mulindwa said that he remains the legitimate winner of the constituency thus, asking his supporters to remain calm, united peaceful as they wait for the outcome of the matter. Mr. Mulindwa speaking….
