The High Court sitting in Fort portal has ruled with costs in favor of Kyabatukura land eviction victims in a petition they filed against Uganda Wildlife Authority.
In his ruling, the high court Judge Vincent Wagona Said without any claim or right, the game warden and game rangers being agents of the first defendant sometime in 2001, attacked injured and killed some of the petitioners while in their homes, injured them with some losing their lives.
Justice Wagona ruled that the petitioners made loses of property including crops on the formerly contested twenty thousand acres of land located at Kyabatukura village, Rugendabara Parish in Kitswamba Sub-County in Kasese district.

In his ruling, Judge Wagona also awarded cost of two hundred million shillings to the plaintiff who other wrongful eviction, they lost property, including crops.
The ruling further asks the defendant to gazette within 30 day the names of the affected farmers in a national daily newspaper from the date of this ruling.

The Counsel representing the plaintiff, Mr. Enoch Wahimba of James Ahebwa and co. advocates asked his clients to fulfil what the ruling requires of them before Judgment date on June 05 2023.
