High court sitting in Fort Portal City has accepted an application filed by the legal team of the Diocese of Kasese demanding for the immediate release of the Diocesan Vehicle impounded by the plaintiff’s bailiff of Aprunali Kithende.
High Court presided over by Hon. Justice Vicent Mugabo on Friday last week heard that in 2023 while in Kasese district, Court Bailiff Jonan Bamwenda illegally impounded the vehicle Reg. No. UAT 143 Q belong to Diocese of Kasese and demanded 3.5 million shillings’ cash to halt Mortaging the vehicle, following land conflicts in Rwentutu between Diocese of Kasese and Kithende.
In his Ruling to the application Hon. Justice Vincent Mugabo directed the legal team of Mr. Kithende Aprunali Kalibogha to release the vehicle, pay back 3.5million shillings and pay additionally over five million for repair of the vehicle that had been parked under sunshine for more than a year.
Speaking to Our Reporter shortly after court the attorney of Eleonora Wismar, who officially handed over her estates to Diocese of Kasese, Mr. Aron Mukababirwa Muhindo, said the Diocesan legal team led by Counsel Kahwa Joseph Muhumuza and Counsel Bwiruka Richard from Kahwa Kafuzi Bwiruka and company advocates will make legal action against the court bailiff of Kithende as instructed by High court.
