The High Court in Kasese has dismissed a case of aggravated defilement against Mr. Joseph Machozi Kule due to lack of witnesses.
Prosecution alleges that on 31st, December, 2020 while in Kyesero one village in Munkunyu Sub County, Kasese district, the accused is reported to have had sexual intercourse with her seven years old biological daughter.

The decision was arrived at after Resident State Attorney Counsel Oundo Geoffrey failed to produce witnesses to testify against the accused persons, alleging they had shifted to unknown location.
Delivering his ruling Hon. Justice David Makumbi said that since state has no hope of getting witnesses he dismissed the case.
Speaking to our Reporter shortly after court session, Defense lawyer Counsel Luke Kanyonyi from Bagenda and Co. advocates said high court Judge accepted his submission of dismissing the case since the suspect had stayed in prison for over three years with no witnesses testifying against him.
