High Court sitting at Fort portal tourism city has dismissed with no costs an application by Kasese Municipality seeking Court order to unconditionally demolish more than forty houses built out of plan.
Court Presided over by the High Court Judge, Vincent Emmy Mugabo heard that forty three houses had been built by local developers without approved plans by Kasese Municipal leadership thus, seeking for orders to demolish the structures.
Dismissing the application, His Lordship Vicent Emmy ruled that court was not satisfied with the submissions of the applicant and no need to demolish the structures.
Speaking to our reporter shortly after court, Mr. Geoffrey Michele, the defence counsel confirmed the application for orders to demolish the houses was dismissed and that the defendants have up to sixty days to apply and their building plans approved by Kasese Municipality leadership. Mr. Michel who asked the two sides to comply with the decision by court, said should the defendants fail to adhere, the applicants will be free to petition High Court for guidance. Mr. Michele speaking2………
